The Legal Position in South Africa

Mediation is recognised as an important part of responsible dispute resolution in South Africa. Under Rule 41A of the Uniform Rules of Court, parties in civil matters must first attempt to resolve the issue through mediation and a court date will only be issued if the request is accompanied by a mediator’s report.
